Account Creation

Your account with ComputeHost will be created after we have received payment we and/or our payment partner(s) have screened the order(s) to prevent any kind of fraudulent activities.

1) You are required to provide us with an email address which should not be @ the domain (s) you are signing up with us under. This email address will serve as primary email address on file to be used to contact you in case of an abuse issue.
2) You are required to update your email address on file at all times
3) You are required to ensure that the contact information provided by you to us/our payment partner (s) is true to the best of your knowledge.

ComputeHost will be not be liable for a lapsed account registration/set up owing to the outdated contact information For addition of new information/verification of the old information submitted, contact our sales team via email. Any kind of false information will lead to the termination of your account.

High Risk Transactions

It is mandatory to provide proof of identification issued by your respective country’s government and a scanned copy of the credit card used for the purchase, in case of high risk transactions or the purchase of dedicated servers. Any failure in catering to these requirements will be considered as fraudulent/result into termination of the account.

Note:

Your billing cycle for the recurring payments with ComputeHost, in case of bank deposits/delayed payments begins from the date you have signed up. E.g. You signed up with ComputeHost on 1st day of the month and did not pay for 8 days, your next invoice will be generated on the 1st of the next month; however your account will be created only after receiving the payment for the service. We request you to make timely payments while using offline modes of payment to prevent any delay in the account setup.

Account Transfers from Previous Hosting Provider

Our account transfer team can help you with your account transfer from your previous hosting company. Please note that it is a courtesy service and does not guarantee any availability or time required to complete the account transfer.

Each hosting company has its own unique configuration as well as data saving formats. Some hosting providers at times save data in an incompatible or proprietary format, which may make it complex to migrate some or all account data. Our account transfer team though puts the best efforts for your account transfer, but in some complex cases (as aforesaid), we may not be able to assist you in data transfer from your old host.

We offer free account transfers from your previous hosting provider for 30 days only from your sign up date. Any transfer beyond 30 days cut off will incur a charge. You may contact our account transfer team with specific details to receive a price quote.

Content

All services offered by ComputeHost will only be used for legitimate purposes. The laws of the Indian Government will be applicable. The customer gives consent to indemnify and hold undisruptive ComputeHost from any claims ensuing from the utilization of our services.

Any use of our services to contravene any copyright or trademark is forbidden. This includes any unconstitutional replication of music files, books, photographs, or any other copyrighted work. The offer of sale of any forged merchandise of a trademark holder will bring about an immediate termination of your account. Any account found to be violating another’s copyright will be immediately revoked, or access to the material ruled out. Any account found to be repeatedly violating copyright laws will be suspended and/or terminated from our hosting. If you believe that your copyright or trademark is being contravened, please email abuse@computehost.com with the information required. You can find the list of required information here. For any request related to licensing issue, we may be requiring further documentation.

Usage of a shared account as a backup/storage device is not permissible, with the exemption of one cPanel backup of the same account. We would request you not to take the backups of your backups.

Hosting of Websites with pornographic or salacious content including indecent photographs, obscene videos, streams and links are not permitted as per the law of the Indian Servers. You may register yourself with ComputeHost.com, if you wish to host legal adult content on your site. Hosting of such type of X rated content on the Indian servers would give rise to suspension of your services without any prior notification and the account won't be entitled for refunds of any kind owing to the nature of the offence being solemn.

Hosting and unauthentic distribution of copyrighted film music from any language is strictly forbidden on the Indian servers. We may have to suspend your website without any prior notification if any complaint is raised about your website disseminating any such content. Plus, we undertake regular audits to keep a stringent check on such content being hosted on or distributed through our servers.

Dissemination of copyrighted music files, game and mobile apps, or any third-party paid software applications through WAP Websites are also not permissible through our servers. We undertake regular audits to keep a stringent check on such content being hosted or disseminated on our servers. As part of our stringent security measures, we stringently do not allow such applications or content to be hosted on our servers.

ComputeHost provides all the services related to equipment, networks and network devices only for authorized customer use. We, at ComputeHost, regularly monitor all systems to keep a check on whether they are used for legitimate purposes or not, including ensuring that use is authorized, for system management, to provide assistance in protection against unconstitutional access, and to corroborate security procedures, survivability, and operational protection. During monitoring, information may be thoroughly probed, recorded, copied and used for permitted purposes. Usage of ComputeHost system(s) implies approval given for conduction of in-depth monitoring for these purposes.

In case, any account found connecting to a third party network or system without prior approval from the third party is subject to immediate deferment. An attempt to access the networks or systems independent of your complete control must be with articulated through written approval from the third party. It may be at the discretion of ComputeHost to request for proper documentation to provide evidence that the access to a third party network or system is authorized.

We reserve all the right to turn down the service request of anyone. Any material that, in our opinion, is obscene, intimidating, illegitimate, or violates our terms of service in any manner may be removed from our servers (or else deactivated), with or without any prior notification.

Failure to timely respond to email from our abuse department within 48 hours may give rise to the deferment or annihilation of your services. All abuse issues must be dealt with via trouble ticket/email and will have a response within 48 hours.
Websites hosted on ComputeHost.com service(s) are regulated only by Indian law.

Latent harm to minors is stringently prohibited, including however not restricted to child pornography or content professed to be child pornography (Lolita): Any website found to be hosting child pornography or connecting to child pornography will be suspended straight away without any prior notification.

Resellers: We reserve all the rights to suspend the website under debate and will send you prior notification so that you may terminate the account. We will further keep a stringent check on your activity; more than one contravention of this type may result in the direct suspension of your account.

Direct customers: Your services will be suspended either with or without any prior notification. Any type of violations will be reported to the appropriate law enforcement organization.

It is your accountability to ensure that scripts/programs integrated under your account are safe and permissions of directories are set appropriately, in spite of integration method. When feasible set permissions on most directories to 755 or as restrictive as possible. Users are ultimately liable for all actions taken under their account. This includes the compromise of confidential information, such as user name and password. It is mandatory that you use a secure password. In case, you used a weak password, then your account may be subject to termination until and unless you consent to use a more secure password. Audits may be conducted regularly to avert weak passwords from being used. If an audit is conducted, and your password is found to be weak, we will timely notify you about the same and give you ample time to change/update your password immediately.

Stringent Spam Policy

We take a strict action against sending of unsolicited e-mail, spam and phishing activities. Both Safe lists and purchased lists shall be treated as a spam. We reserve the right to terminate the accounts of the user found sending spams with or without prior notice.

Websites that are publicized through SPAM cannot be hosted on our servers. The provision contains, but is not restricted to SPAM directed through fax, email, phone, instant messaging, or newsgroups. Any account that leads to the prohibition of our IP space will be straightaway adjourned and/or dismissed.

ComputeHost retains the right to make changes or disable as necessary any web site, database, account or any other such element that does not fulfill its conventional policies, or to make any such amendments in an emergency at its sole decision.

ComputeHost reserves the right to charge the owner of the account used to direct any unwanted e-mail a clean-up fee or any charges incurred for blacklist removal. This cost of the clean-up fee is solely at the choice of ComputeHost.

Compensation Information

Under payment information, one agrees to provide suitable payment for the services received from ComputeHost, in advance of the time period during which such services are rendered. You agree that until and unless you notify ComputeHost of your desire to cancel any or all services received, those services will be billed on a periodic basis.

Cancellations must be done in writing by the cancellation form provided. Once we receive your cancellation form and confirm all essential information with you through e-mail, we will inform you in writing that your account has been canceled. Cancellation sanction received will comprise of a tracking number in the subject for your reference, and for authentication purposes. You will instantly receive an automated email with the tracking number. Our company will sanction your request and accordingly process your cancellation shortly thereafter. In case you do not hear back from us, or do not receive an automated confirmation within sometime after submitting your cancellation, kindly contact us immediately. The cancellations of service are completed through the online form in order to confirm your identity, endorse in writing that you are willing for all files to be removed, and thereafter document the request. This process decreases the possibility of mistakes, fake requests, and confirms that you are aware that the files, emails, and account may be removed straightaway after a cancellation request is processed.

As a customer of ComputeHost, it is your duty to safeguard that your payment information is up to date, and that all the bills are paid on time. You also agree that till the time you inform ComputeHost of your desire to call off any or all services received, those services will be billed on a recurring basis, unless otherwise stated in writing by ComputeHost. ComputeHost reserves the right to bill your credit card or billing information available with us. ComputeHost provides a 5 day grace period from the time the bill is created and when it must be paid. Any invoice that is unsettled for 5 days and not paid will result in a 10% late fee and/or an account suspension until account balance has been paid in full. The 10% late fee is applied in addition to whatever else is owed to ComputeHost for services rendered. Access to the account will not be restored until the payment has been received.

It is the customer's responsibility to notify our sales team after paying for a domain renewal and to ensure that the email is received and acted upon. Domain renewal notices and invoices are provided as a courtesy reminder and ComputeHost cannot be held responsible for failure to renew a domain or failure to notify a customer about a domain's renewal.

Afterwards, domain renewals are billed and renewed 30 days before the renew date. It is the customer's responsibility to inform our sales team for any domain registration cancellation. There can be no refunds made, once a domain is renewed.

ComputeHost reserves the right to modify the monthly payment amount and any other charges any time.

Data Backups and Data Loss

ComputeHost data backup service runs on weekly, daily or monthly basis as per the client requirement. ComputeHost will not be held responsible for any data or file loss, residing on your account. The client will be solely responsible for the files and databases transferred and for maintaining backup of all their files and folders stored on ComputeHost servers.

Refunds and Cancellations

ComputeHost reserves all the right to cancel, suspend or disable the account of the client with or without any prior notification.

A client needs to follow the decorum and maintain the decency when communicating with ComputeHost staff members, irrespective of the issues they have. All our communication channels, including verbal communication over calls are gauged properly and logs are generated to track staff abuse by clients. ComputeHost reserves all the right to suspend your services without any prior information if the offense against you gets proved. In such cases, no refunds will be made, no matter what is your signup date.

Clients’ can cancel their services at any point of time by filling up the cancellation form.
ComputeHost gives you an unconditional 30 days money back guarantee on managed shared hosting, and reseller solutions for any customer who paid the first invoice with a credit card or with Paypal. We hold the right to calculate refund on pro-rata basis.

The requested cancellations for Shared and Reseller accounts after the initial 45 days will get effective on the renewal date for that specific hosting plan. Specific details are required to cancel the services. Any miss in details, will keep your account active until the time it gets expired. The request for refund after the initial 45 days will be calculated on the prorated basis, from the time the request was raised, if it is actually eligible for refund. All the cancellation related requests are handled by ComputeHost cancellation agents.

Below are the methods of payments that are non-refundable. Refunds will be credited to the hosting account:

  • Bank Wire Transfers
  • Cash Deposited in our Bank accounts
  • Western Union Payments
  • Cash deposited through checks
  • Money orders

All the offline payments are non-refundable even if it is eligible under the money back guarantee. There is no provision for refund on dedicated servers, custom software applications installation, domain name purchase, and on administrative payments. Refund requests raised for Shared and Reseller packages after initial 45 days will be calculated on prorated basis.

Semi-annual plans for VPS hosting are not entitled for refunds. Any payment made for these hosting plans can only be adjusted at the time of upgrades to higher version of VPS or dedicated servers.

Only first-time accounts are entitled for raising a refund request. Account re-opened after cancellations are not at all eligible for refunds.

Clients signing up for refunds even when knowing they are not eligible under money back guarantee would be considered as misuse of our refund policies. We have discovered that clients suspended by other web hosts for abuse/spam signup under Money back guarantee just to overload our servers. This is against ComputeHost refund policy, and in such cases no refunds will be made.

Violations of the Terms of Service will waive the refund policy.

Resource Usage

User may not:

1) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.

2) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.

3) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.

4) Run any software that interfaces with an IRC (Internet Relay Chat) network.

5) Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.

6) Participate in any file-sharing/peer-to-peer activities

7) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc

8) Run cron entries with intervals of less than 15 minutes.

9) Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.

10) When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include("http ://yourdomain.com/include.php") use include("include.php")

11) To help reduce usage, do not force html to handle server-side code (like php and shtml).

12) Only use https protocol when necessary; encrypting and decrypting communications is noticeably more CPU-intensive than unencrypted communications.

INODES

Shared account using above 250,000 inodes may be notified with an initial warning. The account may be suspended, in case no action is taken by the account owner. Our back-up system will permanently remove accounts exceeding a limit of 100,000 inode to prevent over usage, but our database will still back-up your files. Each file (an image file, email, webpage etc.) on your user account will use up to 1 inode.

We will only flag those accounts for suspension or/and review, which constantly delete and create huge files, and have multiple files within the system, causing damage to our file system. We will not suspend websites that slightly exceed our inode limits. Users that leave their catchall addresses enabled and never check their primary mailbox account mainly seems to create excessive inodes. Eventually, hundreds of thousands of mailbox messages build up, pushing your account to surpass our inode limits. You can disable your default mail box by first signing-in to cPanel and selecting "Mail" option, setting "Default Address", and typing in: :fail: No such user here.

Back-up Limit

Our off-site weekly back-up will remove shared accounts using above 20 gigs disk space. Only databases will continue to back up. We will continuously move all the data to secondary drive, to prevent data loss in the case of drive failure.

Bandwidth Allocation

There is a monthly bandwidth allocated to you subjected to the hosting package purchased by you. If your account passes the allocated amount we reserve the right to put a halt to your services until the start of next allocation. The account suspension extends till you purchase more bandwidth at an additional fee or you upgrade to a higher package. Allocated bandwidth in a month cannot be carry-forwarded to the next month.

Money back Guarantee

There is no 30 days full money back guarantee on our dedicated server service. We hold the right to calculate refund on pro rata basis.

Each of ComputeHost VPS, managed, reseller and shared servers carry an unconditional money back guarantee of 30 days. You will get a full refund of the paid amount if you express your dissatisfaction within 30 days of your service. Please note, that this money back guarantee does not hold true for our dedicated servers, installation fees for custom software, administrative fees and domain name purchase. New orders or packages will not be activated for customers having any outstanding balance with ComputeHost. Your balance must be zero for a new order or a package to be set up, unless otherwise mentioned by ComputeHost in writing.

Uptime Guarantee

If your reseller/shared server do not meet an SLA of 99.95% uptime, you will be entitled for 5 times the outages for that particular month. E.g. you face a downtime of 2 hours in x month; you will be entitled to a credit of (2 x 5=10) 10 extra hours. However a proper justification needs to be provided for the same requiring an approval by ComputeHost. Monitoring service reports of a third party cannot be submitted as part of the justification to claim amount. The server uptime is defined as the uptime reported from the Apache Web Server and the Operating System which may be different from uptime reported by any individual services. Dedicated servers are not covered under uptime guarantee as they are covered under network guarantee in which credit is calculated on pro rata basis depending on the amount of time server is down.

Reseller is Client Responsibility

ComputeHost provides no support to reseller’s customers. Resellers have to handle their clients themselves. In case any reseller customer contacts us, we hold the right to put the client account on hold unless the reseller assumes full responsibility for their customers. All support requests have to be put forward by the reseller on behalf of their clients for security reasons. Resellers are held responsible for all data transmitted/stored under their reseller account and their customers’ actions. Reseller will be held responsible in case of violation of terms of service or law by any of their clients.

Semi dedicated servers/ non-reseller accounts (shared)

Shared accounts are not entitled to resell web hosting to other customers. You must have a proper reseller account for doing the same. -dedicated servers, backups must be maintained by customers themselves as ComputeHost does not take backups.

Dedicated Servers

In a dedicated server, ComputeHost holds the right to reset the password in case there is no current password on the file. This is needed for security audits to be conducted as needed by our data center. It is client’s responsibility to set a current root password and an email address on file for the dedicated server in order to prevent enforced password resets done by us resulting in downtime.

ComputeHost holds the right to execute administrative actions and conduct audit servers at our datacenter’s request.

Our clients have to maintain backups for dedicated servers as we do not take backups. You may buy an extra hard drive for the same. Please contact sales@computehost.com in case you require a secondary hard drive. Maintaining backups is your responsibility.

Price Revision

The cost of our hosting plan will remain same from the date of purchase. However, any revision on prices of our hosting plans shall be reflected on our website, ComputeHost.com as we reserve the right to revise prices at any time.

Coupons

Our first-time accounts *or first-time customers* are only privileged with discounts and coupon codes on the purchase of our hosting plans. On signing up a website using a specific domain doesn’t necessarily mean you can resign up for that domain using another coupon afterwards. If you have an account with us, you need to abide by these policies that can be assessed by our sales department prior to sending your account invoice. Violation in the use of Coupons can lead to suspension or termination of the account. Coupons or discounts are reserved for only initial purchase, and these deals are not applicable for renewal or recurring price.

Indemnification

Customer comes to an agreement to defend, compensate, protect and support ComputeHost.com on any and all demands, liabilities, losses, costs and claims, such as competitive attorney's fees asserted against ComputeHost, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to shield, compensate and protect ComputeHost against liabilities emerging out of; (1) any damage to person or property resulted in the selling of any products or otherwise distributed in cooperation with ComputeHost; (2) any material delivered by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright violation and (4) any faulty products sold to customers from ComputeHost server.

Arbitration

By availing any services of ComputeHost, you agree to come to a settlement. Arising any disputes or claims against ComputeHost or its holdings will be arbitrated by only ComputeHost arbitrator. An arbitrator will be selected in the state of Texas who is a member of the American Arbitration Association or the National Arbitration Forum. Arbitrators are none other than attorneys or retired judges who shall be appointed as per the rules of Federal laws. All judgments pronounced by the arbitrator will be binding and final. You agree to pay all expenses related to such arbitration.

Disclaimer

Computerhost.com disclaims taking any responsibility in case your business may suffer after using our services. We make no warranties whatsoever with respect to our services. ComputeHost shall not be responsible for any warranty or merchantability in terms of our service delivery capability. This includes data loss occurred from delays, no deliveries, wrong delivery, and any and all service disturbances caused by ComputeHost and its staff.

Law Enforcement Disclosures

ComputeHost can disclose subscriber related information to the law administration agencies, without seeking any notification or consent from the subscribers. We fully comply with the law enforcement bureaus.

Account Downgrades

ComputeHost charges a fee of INR 500, in addition to service tax, for account downgrades. Such accounts do not qualify for free transfers. Data transfer fees is charged based on the data size, when accounts are moved across server at the time of downgrades.

Changes or Modifications in the TOS

ComputeHost reserves all the rights for revising its policies, any time and without providing any further notice to the user.
